• 1st Page of the Agreement should be on Rs.100/- Stamp Paper and all remaining pages should be on white paper with Signed by lessor and lessee. Original Copy should be with the lessor and photocopy should be with the lesee.
  • Rent should always collect via Cheques including Advance Amount.

LEASE AGREEMENT

This Agreement entered into at City/Town/village this __ day of Mon,Year , between Mr.______________ S% _________________aged ___Years, resident of _____(Place) hereinafter called the “LESSOR” (Contextually meaning/including the heirs/ legal representatives/executors/ administrators/assigns) of the ONE PART

AND

Mr.____________ S/o. _____________, aged ___ years permanent resident of ____________________ hereinafter to referred to as the “LESSEE”, of the OTHER PART.

WHEREAS, the LESSOR is absolute and exclusively owner of the PREMISES _____________________________________________________________________(Address of the Premises)

Admeasuring about ____.sft. (In words) and hereinafter called the “PREMISES”, and as the premises is built in ___Year (New Flat) and as the monthly rent is above Rs.1000/- (Rupees one thousand only) it is not covered under the provision of AP Rent Control Act.

WHEREAS the LESSEE being desirous of taking the aforesaid PREMISES and has approached the LESSOR.

WHEREAS the LESSOR agrees to lease to the LESSEE the said PREMISES only for a period of 11 (Eleven Months) starting from 00.00.000 to 00.00.0000 (hereinafter referred as the LEASE PERIOD) for a monthly rent of Rs.____/-(Inwords) payable on or before 5th (fifth) day of each month until the end of term of this Lease Agreement to which offer, the LESSEE has expressed his willingness, and

WHEREAS it is considered expedient that this Agreement of Lease be entered into setting out the terms and conditions governing the PARTIES hereto:

NOW THIS LEASE AGREEMENT WITNESS THAT:

1) That any LEASE AGREEMENT pertaining to this/other PREMISES and with the LESSEE, if entered/executed prior to this LEASE AGREEMENT stands cancelled/terminated/suspended/void.

2) MONTHLY LEASE AMOUNT /LEASE PERIOD

That the LESSOR hereby agrees to lease to the LESSEE, the said PREMISES for a period of 11 months starting from 1st Month-Year to 30th Month Year for monthly rent of Rs.___/- (In words) (hereinafter referred to as the “Lease amount” or “Monthly rent”) payable on or before 5th day of each month.

3) DEFAULT: That if the lease amount payable as per the clause no.2 or any part thereof observed IS NOT PAID or remain unpaid by the LESSEE to the LESSOR for the PREMISES for a period of one calendar month after the same has fallen due, then the LESSOR shall immediately thereupon terminate this Lease Agreement without prejudice to recover any due or claim and take physical possession of the PREMISES immediately without giving any further notice.

4) If any of the terms and conditions herein contained is breached or not performed by the LESSEE or if the LESSEE be adjudged insolvent then the LESSOR shall immediately thereupon terminate this Lease Agreement without prejudice to recover any due or claim.

5) RENEWAL: That the LESSOR and the LESSEE hereby agree that, at their option, the LESSOR may lease this PREMISES to the LESSEE again for such further periods (11 months) by entering into a fresh new lease agreement on mutually agreed terms for this PREMISES (payable by the LESSEE to the LESSOR).

However if no such renewal with fresh new Lease Agreement should take

Place before 15-Mon-year the LESSEE shall be bound to deliver the vacant peaceful possession of the PREMISES by 30-mon-year to the LESSOR, else the LESSOR shall claim damages the PREMISES after 30-mon-year as per clause 21 of this agreement without giving any further notice in writing.

6) NOTICE OF TERMINATION: That it is specifically agreed by and between both the parties that either of the parties can terminate the lease period this PREMISES only after 30-month-year, subject to the principal condition that the lessee shall stay for a minimum period of 11 months and the Lessor shall not insist got the lessee to vacate the premises for a period of 11 months i.e. Either of the parties can serve notice for termination of this lease agreement by giving 30(thirty) days prior notice in writing without assigning any reason whatsoever only after 30-mon-year

7) CAUTION: That the LESSEE shall not invest huge sums of money in Flat by way of furniture or material or for the interiors, decoration etc., in the PREMISES

8) That the LESSEE does not reserve the right to claim from LESSOR for losses/damages incurred by the LESSEE in the event of the LESSOR terminating the lease of the said PREMISES for any reason whatsoever since the LESSEE is abundantly cautioned about the same.

9) MODE OF PAYMENT: That the LESSEE agrees to pay the said rent by way of cheques in favor of Lessor

10) SECURITY DEPOSIT: That the LESSOR acknowledges receipt of Rs.___/- (Rupees In words ) in cash/cheque on this day of agreement, paid towards interest free Deposit by the LESSEE, which amount without interest shall be refunded by the LESSOR to the LESSEE after handing over the vacant peaceful position of the PREMISES after deducting unpaid rent, charges, damages, electricity, taxes, water charges, maintenance or other incidental charges or breakage’s as mentioned clause No.13 of this agreement, liable to be paid or which is found to be unpaid, or payable at a later date on account of non-receipt of the relative demand bills or damage to the PREMISES if any up to the date of handing over the possession by the LESSEE to the LESSOR.

11) That it is agreed specifically by the LESSEE that the LESSEE shall not transfer, assign, sub-let, share or otherwise part with the possession of the whole or part of the said leased PREMISES to any other person or organization or firm. The LESSEE shall NOT enter into any agreement or merge or form any kind of partnership Firm or Propriety Firm or Public/ Private Limited Company and use the said PREMISES for its/their purposes (or to jointly conduct Business at the PREMISES).

12) ELECTRICITY /MAINTENANCE CHARGES:

That the LESSEE shall pay every month maintenance charges of the said premises to the building association directly as demanded by them from time to time. In addition to the rent, electricity charges shall be paid to the APTRANSCO as demanded by them and the water charges to the concerned shall be paid by the LESSEE regularly and punctually in the name of the LESSOR on behalf of the LESSOR or its representatives and the receipted bills in original are to be handed over to the LESSSOR immediately.

The property Taxes shall be paid by the LESSOR.

13) INSPECTION : The LESSEE had INSPECTED the PREMISES which includes all the fittings and Fixtures (Plumbing, electrical, doors, windows, glass panes, tiles wardrobes, painting, taps, tubes, lights,switches etc….) and found to be in perfect and /or working condition on this day of the agreement. The LESSEE has also obtained a letter duly signed by the both the LESSOR and LESSEE with regard to this.

14) REPAIR AND MAINTENANCE: The LESSOR shall keep and maintain the said PREMISES with all fittings and fixtures in good condition at its own cost. The LESSEE shall be responsible to make good for any loss or damage to ALL fittings such as doors, windows, glass panes, tiles, wardrobes, shutters, handles, etc. in the PREMISES and can carry out minor repairs up to Rs.____/- at a time which includes minor plumbing / electrical replacements such as bulbs/tubes/fans/electrical switches of the similar make, taps, showers, washers in valve mixtures/ W/C seat covers etc. if found to be faulty later by usage or/ and by misuse. The LESSEE is allowed to color wash the scheduled PREMISES, at his own cost and expenses.

15) That the LESSEE shall keep the interiors of the leased PREMISES floors, walls, ceiling, doors, windows, electric installations and other fittings and furniture thereof in good condition. Any damage or breakage cost to the same, any part thereof shall be replaced, or the LESSEE shall refund amount equivalent to the damage.

16) USE: That the LESSEE shall be entitled to use the PREMISES for residential purposes only.

17) That the LESSEE shall be entitled to quite peaceful possession on enjoyment of the PREMISES as long as the LESSEE faithfully discharges the obligation as a tenant under this agreement

18) That the LESSEE shall not cause any nuisance and/ or inconvenience or annoyance or disturbance to the other tenants/occupants in the Apartments in the said PREMISES or near thereof to others. The LESSEE shall not resort to any unlawful or illegal or immoral and/ or is of improper nature contrary to the reputation of the building or store any explosives/fire arms/ crackers or any other chemicals which will/would cause any harm/damage.

19) That the LESSOR shall not be responsible or liable in any manner what so ever due to loss of movable/ immovable property belonging to the LESSEE and /or loss of life or any kind of injury that my happen to any other persons (Legal/natural) whatsoever of the LESSEE or on behalf of the LESSEE, or its agents, its servants, its customers, its visitors, its invites and other persons using or present in the leased PREMISES that may be caused due to reason/ reasons of fire, rains, floods, lightning, natural calamities, electric short circuits, accidents or due to any structural weaknesses of the building structure or due to thefts, dacoity, or due to government/executive orders, judicial/legal orders, or competent authorities orders, or military/police action, acts of war, or due to terrorism, strikes, civil commotion, protests or any other reasons whatsoever in and around the leased PREMISES. The LESSEE agrees to get all properties/ materials present in PREMISES insured ( Insurance) for all of the any reasons applicable above.

20) That the LESSEE shall strictly observe the aforesaid terms and conditions and if the LESSEE violates and/or does not comply with any of the terms and conditions as mentioned herein above this LEASE AGREEMENT may be terminated by issuing 30 (thirty) days notice for Termination.

21) That further if the LESSEE fails to hand over for any reason what so ever the vacant peaceful possession of the PREMISES due to the termination of this LEASE PERIOD/ AGREEMENT the LESSEE agrees to thereafter pay to the LESSOR a sum of Rs._______/- (Rupees Inwords ) as charges/damages for each calendar month in addition to monthly rent for the first year, and thereafter Rs.______/- (Rupees Inwords ) as charges/damages for each calendar month in addition to monthly rent for the Second year and thereafter Rs.________/- (Rupees Inwords) as charges/damages for each calendar month in addition to monthly rent for the third year and beyond, UNTIL the vacant peaceful possession of the PREMISES is handed over to the LESSOR by the LESSEE.

22) That on termination of this agreement, the LESSEE undertakes to handover the peaceful possession of the PREMISES to the LESSOR in good condition failing which clause No.21 of this agreement would be applicable.
