			<content:encoded><![CDATA[<p>I am mentioning some of the points where most of the apartments/residential societies are facing such problems. By implementing some rules mentioned below may get solve. Try it and give me feedback.</p>
<p>1. Any Functions/Parties to be organized in the parking Area/Terrors by the residents, should be informed to the Association and to the flats by issuing curricular and displaying the same on the Notice Board. Electricity, Lift maintenance, water and cleaning charges of Rs&#8230;&#8230;/- will be collected per day. This should be informed one week on a prior to the function/party. Apart from other expenses, premises are charged at a minimal amount of Rs&#8230;../- i.e. Total Expenses of Rs&#8230;&#8230;/- per day. This amount can be used as corpus fund.</p>
<p>2. Vacating or New occupation in apartment should pay Rs&#8230;/- towards maintenance expenses of the lift, Electricity and cleaning, because the lift will be used during the house shifting and this amount is compulsory. Vacating or New occupants should also inform to the association on prior basis because of security reasons. Owners of the flats should take the initiative to inform to the association</p>
<p>3. All the expenses involved during the month will be displayed on the notice board including those who have not paid the maintenance charges with the arrears. Note: For any repairs, the association can take a decision upto Rs&#8230;../- in the event of the amount exceeding Rs&#8230;&#8230;/- curricular for the same will be issued and subsequent meeting organized if majority acceptance is not met.<span id="more-129"></span></p>
<p>4. The association has appointed a Maintenance person(Plumbing/Electricity) for supporting small works. This person will be available on every &#8230;&#8230;&#8230;&#8230;&#8230;.day.  Expenses towards materials will have to be paid by the residents. A separate book will be available with the watchman. You can write your problem with the flat number mentioned in the notebook, so that Maintenance person will do all the jobs systematically. After completion of the job, please write work completed and what problem attended.</p>
<p>5. In the event of any complaints please feel free to write in the complaints book which will be available with the watchman, so that everyone will know about the issue and the association will react to it immediately. All complaints and queries should be mentioned in the complaint book. A meeting will be organized if the problems is not solved. If anyone has not complained in the complaint book, that problem will not be taken into consideration in the meeting. It can be scheduled in the next meeting.</p>
<p>6. Maintenance charges should be paid on or before &#8230;&#8230;&#8230; of every month to meet the bills, so all the residents in this apartment should pay within the time period specified.</p>
<p>7. Any implementation of new amendments, curricular will be issued with the watchman so that all the residents in the apartments can sign and also feel free to write any comments or suggestions relating to that. Majority acceptance will be taken as granted.</p>
<p>8. All the residents in the apartments should also feel responsible towards maintenance of the premises . Please write any suggestions in the suggestion/complaint  book</p>
<p>9. Lift will not be allowed for Newspaper/Milk supplier strictly. This will apply for multiple vendors.  Incase single supplier will not have any problem</p>
<p>10. Visitor vehicles and outside vehicles will not be permitted to park or given parking area for lease because of security reasons.</p>
<p>11. Flats should not be given/leased out for usage of Office/ Guest house/ Business etc.. commercial use of the premises is not permitted in this apartment.</p>

The LESSEE shall NOT enter into any agreement or merge or form any kind of partnership Firm or Propriety Firm or Public/ Private Limited Company and use the said PREMISES for its/their purposes (or to jointly conduct Business at the PREMISES).</span></p>

<p class="MsoNormal" style="margin-left: 14.15pt; text-align: justify;"><span style="font-size: 10pt;">That the LESSEE shall pay every month maintenance charges of the said premises to the building association directly as demanded by them from time to time. In addition to the rent, electricity charges shall be paid to the APTRANSCO as demanded by them and the water charges to the concerned shall be paid by the LESSEE regularly and punctually in the name of the LESSOR on behalf of the LESSOR or its representatives and the receipted bills in original are to be handed over to the LESSSOR immediately.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt;"><span> </span>The property Taxes shall be paid by the LESSOR.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 10pt;"> </span></p>
<p class="MsoNormal" style="margin-left: 14.15pt; text-align: justify; text-indent: -14.15pt;"><!--[if !supportLists]--><span style="font-size: 10pt;"> <span>13)<span style="font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-stretch: normal; font-family: "> </span></span></span><!--[endif]--><strong><span style="text-decoration: underline;"><span style="font-size: 10pt;">INSPECTION :</span></span></strong><span style="font-size: 10pt;"><span> </span>The LESSEE had INSPECTED the PREMISES which includes all the fittings and Fixtures (Plumbing, electrical, doors, windows, glass panes, tiles wardrobes, painting, taps, tubes, lights,switches etc&#8230;.) and found to be in perfect and /or working condition on this day of the agreement. The LESSEE has also obtained a letter duly signed by the both the LESSOR and LESSEE with regard to this.</span></p>
<p class="MsoNormal" style="margin-left: 14.15pt; text-align: justify; text-indent: -14.15pt;"><!--[if !supportLists]--><span style="font-size: 10pt;"><span>14)<span style="font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-stretch: normal; font-family: "> </span></span></span><!--[endif]--><strong><span style="text-decoration: underline;"><span style="font-size: 10pt;">REPAIR AND MAINTENANCE:</span></span></strong><span style="font-size: 10pt;"><span> </span>The LESSOR shall keep and maintain the said PREMISES with all fittings and fixtures in good condition at its own cost. The LESSEE shall be responsible to make good for any loss or damage to ALL fittings such as doors, windows, glass panes, tiles, wardrobes, shutters, handles, etc. in the PREMISES and can carry out minor repairs up to Rs.____/- at a time which includes minor plumbing / electrical replacements such as bulbs/tubes/fans/electrical switches of the similar make, taps, showers, washers in valve mixtures/ W/C seat covers etc. if found to be faulty later by usage or/ and by misuse. The LESSEE is allowed to color wash the scheduled PREMISES, at his own cost and expenses.</span></p>
<p class="MsoNormal" style="margin-left: 14.15pt; text-align: justify; text-indent: -14.15pt;"><!--[if !supportLists]--><span style="font-size: 10pt;"><span>15)<span style="font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-stretch: normal; font-family: "> </span></span></span><!--[endif]--><span style="font-size: 10pt;">That the LESSEE shall keep the interiors of the leased PREMISES floors, walls, ceiling, doors, windows, electric installations and other fittings and furniture thereof in good condition. Any damage or breakage cost to the same, any part thereof shall be replaced, or the LESSEE shall refund amount equivalent to the damage.</span></p>

The LESSEE shall not resort to any unlawful or illegal or immoral and/ or is of improper nature contrary to the reputation of the building or store any explosives/fire arms/ crackers or any other chemicals which will/would cause any harm/damage.</span></p>
<p class="MsoNormal" style="margin-left: 14.15pt; text-align: justify; text-indent: -14.15pt;"><!--[if !supportLists]--><span style="font-size: 10pt;"><span>19)<span style="font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-stretch: normal; font-family: "> </span></span></span><!--[endif]--><span style="font-size: 10pt;">That the LESSOR shall not be responsible or liable in any manner what so ever due to loss of movable/ immovable property belonging to the LESSEE and /or loss of life or any kind of injury that my happen to any other persons (Legal/natural) whatsoever of the LESSEE or on behalf of the LESSEE, or its agents, its servants, its customers, its visitors, its invites and other persons using or present in the leased PREMISES that may be caused due to reason/ reasons of fire, rains, floods, lightning, natural calamities, electric short circuits, accidents or due to any structural weaknesses of the building structure or due to thefts, dacoity, or due to government/executive orders, judicial/legal orders, or competent authorities orders, or military/police action, acts of war, or due to terrorism, strikes, civil commotion, protests or any other reasons whatsoever in and around the leased PREMISES. The LESSEE agrees to get all properties/ materials present in PREMISES insured ( Insurance) for all of the any reasons applicable above.</span></p>
<p class="MsoNormal" style="margin-left: 14.15pt; text-align: justify; text-indent: -14.15pt;"><!--[if !supportLists]--><span style="font-size: 10pt;"> <span>20)<span style="font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-stretch: normal; font-family: "> </span></span></span><!--[endif]--><span style="font-size: 10pt;"><span> </span>That the LESSEE shall strictly observe the aforesaid terms and conditions and if the LESSEE violates and/or does not comply with any of the terms and conditions as mentioned herein above this LEASE AGREEMENT may be terminated by issuing 30 (thirty) days notice for Termination.</span></p>
